Adult Kickball Equinox Cup (Tuesdays)

By registering, I agree, warrant and covenant as follows: In consideration of being allowed to participate in any way in Mysiti Sports athletic sports program, related events and activities, the undersigned acknowledges, appreciates, and agrees that: 1.    Physical Condition: I represent that I, or my child, am in good physical condition and have no medical reason or impairment that might increase the health risks to myself or others participating in Mysiti Sports leagues and events. Further, I agree to stop and consult my healthcare provider if I, or my child, experience faintness, dizziness, pain, or shortness of breath at any time while participating in any Mysiti Sports league or event. 2.   I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my, or my child’s, participation; and, 3.   I willingly agree to comply with the stated and customary terms and conditions for participation. Accordingly, I certify that I am over the age of 21 and that I will not invite or knowingly allow anyone who has not signed this same waiver and release to participate on my team for adult events.  If, however, I observe any unusual significant violation or hazard including suspected intoxication, infection or misconduct during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, 4.  I, for myself or my child, and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Mysiti Sports their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law and including but not limited to the condition of any playing field and/or equipment. 5.  Property damage caused by any Mysiti participant not through the normal course of game play shall be the sole responsibility of the participant. 6.    Email: I understand that Mysiti Sports will use my email address as its primary means of league-related business communication with me. 7.   Photo Release: I understand that Mysiti Sports takes photos & videos at most of its leagues and events and I grant permission for my image to be distributed by email, internet, social, and other media.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

REFUND POLICY. NO REFUNDS SHALL BE ISSUED under any circumstances including but not limited to:

1. seasons delayed; and,

2. schedules revised; and,

3. games played on same day, different day, different time, and/or at different venues; and,

4. games not played as the result of continuous extreme weather, natural disaster, pandemic, terrorism, or other unforeseen circumstance; and,

5. individual or group's decision not to participate. If a cancellation takes place prior to registration closing and shirts being ordered for that league or event, then a credit for a future Mysiti Sports activity in the same calendar year may be issued.

Covid 19 Acknowledgement

COVID-19 is extremely contagious, that another person can unknowingly carry the virus without exhibiting symptoms, that any activity which brings people in close proximity does increase the chance of transmission for 14 days or more, and that Mysiti Sports makes no claims or guarantees that participation in its leagues and events will not result in COVID-19 related injury, illness, disability or death to any participant or their spouse, guests, unborn child, relatives, friends or associates, especially those age 65 or older.

Note: This waiver remains in effect from year to year, so long as Member participates in the Mysiti Sports.
